Welcome to Apex. The Apex iPhone app, its Apple Watch app and widgets, and our website at apexapp.site (together, the "Service") are provided by Mohan Prakash Jeyasankar, an individual developer based in the United Kingdom who makes Apex as a free, non-commercial passion project ("Apex," "us," "our," or "we"). Apex is not a company: "we" and "us" in these Terms mean Mohan Prakash Jeyasankar. Certain features of the Service, such as clubs, may have extra rules shown in the app (for example, the Club rules you accept before you post). Those rules form part of these Terms.
These Terms of Use ("Terms") are the agreement between you and us for using the Service. We have kept them as plain as we can. By creating an account or using the Service, or by tapping "Agree" (or a similar button) when it is shown to you, you agree to these Terms. You must be at least 18 years old to use the Service. If you do not agree to these Terms, please do not use the Service.
Apex is free. There are no ads, no in-app purchases and no subscriptions. If we ever introduce paid features, we will tell you the price and terms clearly before you pay anything.
There is zero tolerance on Apex for objectionable content or abusive users. Please read section 6.
1. Who can use Apex
- 1.1 18 and over only. You must be 18 or older. We ask for your birth year to check this. Giving a false birth year breaks these Terms, and we will close accounts we believe belong to someone under 18.
- 1.2 Able to agree. You must be able to make a binding agreement, and not be barred from using apps like Apex under the laws that apply to you.
- 1.3 One person, one account. Accounts are personal. They can't be shared, sold or transferred.
2. Your account
- 2.1 Creating an account. You sign in with Apple. Please keep the information in your profile accurate. Your display name must not impersonate anyone.
- 2.2 Account security. Keep your Apple account secure, because anyone with access to it can use Apex as you. You are responsible for activity under your account. If you think someone else has used your account, tell us straight away at support@apexapp.site.
- 2.3 Deleting your account. You can delete your account at any time in the app: tap your avatar, then Settings → Delete Account. Our Privacy Policy explains what happens to your data.
3. Health and safety
- 3.1 Apex is not medical advice. Training plans, coaching, heart-rate and pace zones, training-load and fitness numbers, weather suggestions and AI coach answers are general fitness information. They are not a diagnosis or treatment, and they don't replace a doctor, physiotherapist or qualified coach. Apex is not a medical device.
- 3.2 Check with a professional first if you are pregnant or have recently given birth, have a heart, lung or other medical condition, are returning from injury, take medication that affects your heart rate, or are unsure whether exercise is safe for you.
- 3.3 Listen to your body. Stop and get help if you feel chest pain, dizziness, faintness or unusual shortness of breath. In an emergency, call your local emergency number.
- 3.4 Numbers can be wrong. GPS, heart-rate and other Bluetooth sensors, imported files, step counts, calorie estimates, segment times and weather forecasts are approximate. Don't rely on them for anything where your safety depends on them.
- 3.5 Run and ride safely. Obey traffic laws and local rules. Run and ride only where it is legal and safe. Wear a helmet when you ride. Don't look at your phone while moving through traffic, and keep audio low enough to hear what's around you.
- 3.6 Protect your privacy outdoors. Tell someone your plans, vary your routes and times, trust your instincts, and avoid places where you don't feel safe. Think twice before sharing routes, photos or workout cards that show where you live or regularly go. Share your live position only with people you trust, and treat a private live link like a key. Privacy zones help keep places like your home out of saved routes and segments, but they don't apply to a live share.
- 3.7 The AI coach can make mistakes. Its answers are generated automatically on your iPhone and may be inaccurate or incomplete. Use your own judgement.
- 3.8 Live sharing is not a safety or emergency service. A live share can be delayed, inaccurate or stop (no signal, a flat battery, a stopped app), and the "expected back by" note is only a message on a web page: nobody is called and the emergency services are not contacted. Don't rely on it to get help. In an emergency, call your local emergency number.
- 3.9 Planned routes are a guide. The route builder follows paths from Apple Maps where it can, and draws straight lines where it can't. A route may cross roads, private land or places that are closed or unsafe, and the off-route alert can be late or wrong. Check a route before you follow it, and follow local signs and laws.
You take part in physical activity at your own risk, and you are responsible for deciding what is right for your body. This does not limit our liability where the law does not allow it to be limited (see section 13).
4. Access to the Service
- 4.1 Licence. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Apex app on Apple-branded devices that you own or control, as permitted by Apple's Usage Rules, for your own personal, non-commercial use.
- 4.2 Restrictions. You may not: (i) license, sell, rent, lease, transfer, assign, distribute or commercially exploit the Service or any content in it; (ii) modify, create derivative works from, disassemble, decompile or reverse-engineer any part of the Service, except as the law allows; (iii) access the Service to build a similar or competing product; (iv) copy, reproduce, distribute, republish, download, display, post or transmit any part of the Service except as these Terms allow; or (v) scrape, harvest or collect data about other members, or use bots or automated means to access the Service.
- 4.3 Changes to the Service. Apex is evolving. We may add, change, suspend or remove features. If a change significantly affects you, we will tell you in advance where we reasonably can. If we ever shut Apex down entirely, we will give you reasonable notice so that you can export your data.
- 4.4 Support. We provide support by email at support@apexapp.site. We will do our best to help, but we can't promise particular response times.
- 4.5 Ownership. Apex, including its design, code, training plans, stories, illustrations, text and trademarks, belongs to us or our licensors. These Terms do not transfer ownership of any of it to you. All rights not expressly granted to you are reserved.
- 4.6 Feedback. If you send us ideas or suggestions, you allow us to use them freely, in any way and for any purpose, without paying you or crediting you. Please don't send us anything you consider confidential.
5. Privacy
- 5.1 Privacy Policy. Our Privacy Policy at apexapp.site/privacy explains what personal data we collect, how we use it and when we share it. If these Terms and the Privacy Policy conflict about your personal data, the Privacy Policy controls.
- 5.2 Cookies and tracking. We do not use cookies or tracking technologies on our website or in the app. Our Cookie Notice at apexapp.site/cookies explains this, and the data the app keeps on your iPhone so it can work.
6. The Club and community
The Club tab ("My clubs"), challenges and leaderboards are meant to feel welcoming, especially for women who have felt unwelcome elsewhere. There is zero tolerance for objectionable content or abusive users.
How clubs work. A club is a private group of up to 50 people. You can be in several clubs and own up to 10. Clubs are private and invite-only: people who aren't members can't see a club or anything in it, and there is no search, public feed or public club page. You can only join with an invite code or link. Invite codes are made on our servers, work for 48 hours, can have a maximum number of uses and can be cancelled. Anyone with a valid code can join until it expires or is cancelled, so only share an invite with people you know. Clubs are feed-based: members post, comment and like. There is no real-time chat, no direct messaging and no voice or video, and you agree not to try to use Apex for any of them.
Roles. Each club has one owner and may have admins. The owner and admins can create and cancel invites, remove members (a removed person can't rejoin that club), delete any post or comment in the club, and edit the club's name, description, colour, glyph and focus. Only the owner can promote or demote admins, switch invites on or off, hand the club to another member and delete the club. Anyone can leave a club at any time; an owner must hand the club over or delete it first. If an owner deletes their Apex account, the club passes to its longest-serving admin (otherwise member), and is deleted only if nobody else is in it. Deleting a club deletes all its posts, comments, likes, invites and club challenges.
What members can see. Members of a club can see each other's display name, avatar and role, what each person posts in that club (text, a photo, or a run or ride summary card), and each member's weekly minutes and distance on the club leaderboard. Through the club they can never see your recorded routes, start or end points, location, heart rate or other health data. They see a planned route or a segment only if you share it with that club, and your live position only if you start a live share and pick them. Our Privacy Policy explains what each of these shows. Only we (Apex moderation) can see club content from outside the club, to deal with reports. Our Privacy Policy explains this in more detail.
If you own or run a club. Owners and admins must enforce the Club rules in their club, act on reports and remove content and members that break them. You must not use a club, or its invites, to harass or bully anyone, to sell or advertise anything, to recruit or contact anyone under 18, or to collect or share other people's locations. You are responsible for who you invite. Being an owner or admin doesn't change our responsibility to act on reports, and we will act on reports about clubs, and on the people who run them, as set out below.
You agree not to:
- harass, bully, threaten, stalk, intimidate, demean or sexualise anyone, or send unwanted romantic or sexual attention;
- post hate speech, or content attacking people based on sex, gender identity, sexual orientation, race, ethnicity, religion, disability, age or body size;
- post sexually explicit, violent or graphic content, or anything that promotes self-harm or disordered eating;
- share anyone else's personal information, location or photos without their permission;
- impersonate anyone or misrepresent who you are;
- spam, advertise or sell without our permission, or post misleading health claims;
- post links, or put them in a club's name or description (links aren't allowed anywhere in the Club yet);
- invite or contact anyone you know or suspect to be under 18, try to rejoin a club you have been removed from, or try to guess invite codes;
- post anything illegal, or anything that infringes someone else's rights, including their copyright or privacy;
- cheat leaderboards, segments or challenges with faked, edited or vehicle-assisted activities;
- create or share a route or segment to reveal where someone else lives or regularly goes, or to lead people onto private land or into unsafe places;
- try to get into accounts or data that aren't yours; or
- interfere with, overload or attack the Service or its servers.
Reporting and blocking. If someone makes you uncomfortable, or you see content that breaks these rules, report the post, comment, challenge or member in the app (from the menu on it) or email support@apexapp.site. Content you report is hidden from you straight away. Reports come to us (Apex moderation), not to your club's owner or admins. You can also block a member, so that you no longer see each other's posts, comments or entries in a club's member list, and neither of you can join the other's clubs; manage the people you have blocked in You → Safety & privacy → Blocked people (tap your avatar to open You). We review reports and act on objectionable content within 24 hours, by removing the content and, where appropriate, removing the member who posted it. If you are in immediate danger, contact your local emergency services first.
What we can do. We may remove any content, remove or close any club, limit features, or suspend or close any account that we reasonably believe breaks these Terms or puts others at risk. This includes clubs whose owner or admins don't enforce the Club rules, and clubs used for the things listed above. Where it is safe and appropriate, we will tell you why. We don't monitor everything that is posted, but we take every report seriously.
7. Illegal content and complaints
How we deal with illegal content. We don't allow illegal content on Apex. When we learn of it, from a report, a complaint or our own checks, we review it and take it down swiftly, normally within 24 hours. We act immediately on child sexual exploitation and abuse content: we remove it, close the account and report it to the National Crime Agency. We act immediately on terrorism content: we remove it, close the account and report it to the police. For all other illegal content, we remove it within 24 hours of becoming aware of it and suspend or close accounts that post it.
Reporting. You can report a post, comment, challenge or member from the menu on it in the app (including with the reason "Child safety"), or email support@apexapp.site.
Automatic checks. Before you post, the app checks your post, comment, challenge, club name or description, or display name on your iPhone against a short list of slurs, sexual terms and threats, and for web links, which aren't allowed in the Club yet. If it matches, the app asks you to reword it. Nothing is sent to us when this happens. We don't scan photos automatically. If you think the check has stopped a post unfairly, tell us.
Complaints and appeals. You can complain to support@apexapp.site about content you think is illegal, about our decision to remove your content or restrict your account (an appeal: put "Appeal" in the subject line), about our automatic checks, or about how we meet our online safety duties. We acknowledge complaints, tell you how long we expect to take, and decide appeals within 7 days. If we got it wrong, we restore your content or account. If you think we have broken our contract with you, you may also bring proceedings in court.
8. The Couples and Duo stories
Couples (with a partner) and Duo (with a friend or family member) are for two people who both want to run together. They work the same way: each shares only your first name and weekly workout minutes with the other person (live sharing is separate, and only starts when you start it), and we expect it to be used in that spirit:
- 8.1 Only pair with someone who has freely chosen to pair with you. Never pressure, trick or coerce anyone into sharing an invite code or joining.
- 8.2 Never use Apex to monitor, track or control anyone. Using Couples, Duo, live sharing or any part of Apex, to check up on a partner, ex-partner or anyone else against their wishes breaks these Terms, and we will close accounts that do. Apex only shares a live location when the person who is sharing starts a share and chooses who sees it. You may use live sharing only with the consent of the person who is sharing: never pressure anyone to start a share, keep one running or hand over a link, and never ask for or use a link to follow someone who has not agreed.
- 8.3 Either of you can leave at any time in Story settings (the gear on the Story tab), without giving a reason. Leaving is quiet: we don't notify the other person.
- 8.4 If you feel someone is using Apex to control or watch you, leave the couple or duo, stop any live share you have running (this switches its link off straight away) and contact us. We will help.
Summit, the third story, is solo: it shares nothing with anyone. The receipt on each stamp is worked out on your iPhone from your own workouts. It is there for encouragement, not as medical or training advice.
9. Your content
- 9.1 It stays yours. Your workouts, posts, photos, comments, routes and other things you add to Apex ("your content") remain yours.
- 9.2 The licence you give us. So that we can run Apex, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and adapt (for example, resize or re-encode) your content, only to operate and provide the Service and only in line with your settings and our Privacy Policy. For content you make visible to other members, such as Club posts, routes and segments you share, and your segment times, the licence also covers showing it to the members you chose (for example, the members of that club, your partner, or members on public boards if you opt in). The licence ends when you delete the content or your account, except for copies we must keep by law or to deal with a report or legal claim.
- 9.3 Your promises. You confirm that you have the right to post your content and that it doesn't break these Terms or anyone else's rights.
- 9.4 Keep your own copies. You can export your runs and rides in Settings → Your data → Export my data, and each planned route as GPX from its page. We are not a backup service.
- 9.5 Files you import. Only import files (FIT, GPX or TCX) that you have the right to use, such as your own workouts. Apex reads them on your iPhone and saves the workout in them; the file itself is not uploaded.
10. Third-party services and other users
- 10.1 Third-party services. Apex works with services and devices made by others, such as Apple Health, Apple Maps, Apple Weather, the Apple Watch Workout app, Bluetooth sensors you pair and the watch apps you export files from ("Third-Party Services"). We don't control them and are not responsible for them. Their own terms and privacy policies apply when you use them.
- 10.2 Other users. Your dealings with other members are between you and them. We are not responsible for what other members say or do, but we may step in where someone breaks these Terms (see section 6).
- 10.3 Release (US users). If you live in the United States, to the fullest extent permitted by law, you release us and our officers, employees, agents, successors and assigns from claims arising from disputes with other members or from Third-Party Services. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
11. Apple App Store terms
If you downloaded Apex from Apple's App Store, these terms also apply:
- 11.1 Acknowledgement. These Terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for Apex and its content.
- 11.2 Scope of licence. Your licence to use Apex is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Apex may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- 11.3 Maintenance and support. We are solely responsible for providing any maintenance and support for Apex, as described in these Terms or as required by law. Apple has no obligation to provide any maintenance or support for Apex.
- 11.4 Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed. If Apex fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Apex to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Apex, and any other claims, losses, liabilities, damages, costs or expenses caused by any failure to meet a warranty are our responsibility, to the extent these Terms do not exclude them.
- 11.5 Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Apex or your possession or use of it, including: (i) product liability claims; (ii) any claim that Apex fails to meet any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar laws, including in connection with Apex's use of the HealthKit framework.
- 11.6 Intellectual property rights. If a third party claims that Apex or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
- 11.7 Legal compliance. You confirm that (i) you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country, and (ii) you are not listed on any US Government list of prohibited or restricted parties.
- 11.8 Developer name and contact details. Apex is developed by Mohan Prakash Jeyasankar, an individual developer in the United Kingdom. Questions, complaints or claims about Apex should be sent by email to support@apexapp.site.
- 11.9 Third-party terms. You must comply with the terms of any third-party agreement that applies when you use Apex (for example, your mobile data plan).
- 11.10 Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
12. Disclaimers
We work hard to make Apex reliable and accurate, but the Service is provided "as is" and "as available". To the fullest extent permitted by law, we and our suppliers disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Service will be uninterrupted, error-free, secure or free of viruses, or that any data, estimate or suggestion it gives you will be accurate.
If you are a consumer in the UK or the EU, this section does not affect your statutory rights, for example under the UK Consumer Rights Act 2015 or the consumer laws of the country where you live, including your right to digital content that is of satisfactory quality, fit for purpose and as described.
13. Limitation of liability
- 13.1 What we never limit. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. If you are a consumer, nothing in these Terms affects your statutory rights.
- 13.2 Subject to section 13.1, and to the maximum extent permitted by law:
- we are not liable for losses that were not reasonably foreseeable when you started using the Service, for loss of profits, business or opportunity (Apex is for personal use), or for indirect, consequential, special or punitive damages;
- we are not liable for injury or loss arising from physical activity you choose to do, except where it is caused by our negligence or breach of these Terms;
- we are not liable for what other members say or do, or for Third-Party Services; and
- our total liability to you for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) £100 and (b) the amount you paid us in the 12 months before the event giving rise to the claim. Having more than one claim does not increase this limit.
14. Indemnification
To the extent the law allows, if you use the Service in breach of these Terms or the law, and that causes a claim against us by someone else, you agree to cover our reasonable losses and costs (including reasonable legal fees) resulting from that claim. We will tell you promptly about any such claim we become aware of. If you are a consumer in the UK or the EU, this section applies only to losses that were reasonably foreseeable and caused by your breach.
15. Term and termination
- 15.1 Ending your account. These Terms apply while you use the Service. You can stop using Apex and delete your account at any time: tap your avatar, then Settings → Delete Account. You can export your runs and rides first in Settings → Your data → Export my data.
- 15.2 When we can end it. We may suspend or close your account, and remove any club you own or run, if you seriously or repeatedly break these Terms, if we must do so by law, or to protect members or the Service. Where it is safe and appropriate, we will tell you why and give you a chance to respond.
- 15.3 What survives. Sections 3 (Health and safety), 4.2 to 4.6, 9.2 (for content already shared, until it is deleted), 10, 12, 13, 14, 16 and 18 continue to apply after your account ends.
16. Disputes and governing law
- 16.1 Talk to us first. If you have a problem, please contact us at support@apexapp.site. Most problems can be solved with a conversation, and we will try to resolve yours within 30 days.
- 16.2 Governing law. These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of England and Wales.
- 16.3 Courts. The courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK, in the EU or anywhere else, you also keep the protection of the mandatory consumer laws of the country where you live, and you can bring proceedings in your local courts.
- 16.4 Small claims and injunctions. Either of us may bring an individual claim in a small claims court, and either of us may ask any court with jurisdiction for an injunction to protect intellectual property rights.
17. US state-specific notices
- 17.1 California. Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: the provider of the Service is Mohan Prakash Jeyasankar, an individual developer in the United Kingdom. To file a complaint about the Service, or to get more information about using it, email support@apexapp.site. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
- 17.2 Privacy rights in your state. California, Colorado, Connecticut, Virginia, Texas, Oregon and other states give their residents privacy rights, such as rights to access, correct and delete personal data. Our Privacy Policy explains how to use them. We do not sell personal data, use it for targeted advertising, or use it for profiling that has legal or similarly significant effects, so there is nothing to opt out of.
18. General
- 18.1 Changes to these Terms. We may update these Terms. If a change matters, we will tell you in the app before it takes effect. If you keep using Apex after it takes effect, the new Terms apply. If you don't agree, you can delete your account at any time.
- 18.2 Export. You agree not to export, re-export or transfer the Apex app in breach of US export control laws or other applicable export laws.
- 18.3 Electronic communications. You agree that we can communicate with you electronically, by email or by notices in the app. These communications satisfy any legal requirement for written notice.
- 18.4 Accessibility. We want Apex to be usable by everyone, including people with disabilities. If you find something hard to use, or have ideas for making Apex more accessible, please contact us at support@apexapp.site. We will make reasonable efforts to address it promptly.
- 18.5 Entire agreement. These Terms (together with the Privacy Policy, the Cookie Notice and any rules for specific features shown in the app) are the entire agreement between you and us about the Service. If a court decides part of these Terms is invalid, it will be changed as little as necessary to make it valid, and the rest still applies. If we don't enforce a right straight away, we can still enforce it later. "Including" means "including without limitation".
- 18.6 Transfer. We may transfer our rights and obligations under these Terms to another organisation, for example if Apex is sold; your rights won't be reduced as a result. You can't transfer yours.
- 18.7 Third-party rights. Except for Apple (section 11.10), nobody else has rights under these Terms.
- 18.8 Copyright and trademarks. Copyright © 2026 Mohan Prakash Jeyasankar. All rights reserved. Trademarks and logos shown in the Service belong to us or to third parties. You may not use them without the owner's prior written permission.
- 18.9 Contact. Mohan Prakash Jeyasankar, United Kingdom, by email only. Support and reports: support@apexapp.site. Privacy: privacy@apexapp.site.
